Terms of Use

These Terms of Use govern your access to and use of the Humark platform. By using our Service, you agree to these terms in their entirety. Please read them carefully, particularly the Creator Attestation and Registration Integrity provisions.
Acceptance of Terms
By accessing or using the Humark platform, website, mobile application, API, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use. If you do not agree to all of these terms, you may not access or use the Service.
Humark reserves the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will notify users of material changes via email or in-app notification.
Operating Entity
The Humark platform, including humark.id and the Humark mobile application, is owned and operated by AU-SVRN, a brand management company that stewards Humark and related identity infrastructure products. References to "Humark," "we," "us," and "our" throughout these Terms refer to AU-SVRN acting through the Humark brand.
Notices, legal correspondence, and process related to these Terms may be directed to AU-SVRN at legal@humark.id, which is monitored on AU-SVRN’s behalf.

Service Description
Humark is a biometric attribution and provenance infrastructure platform for creative work. The Service enables human creators to cryptographically sign their original works using device-level biometric authentication, generating tamper-evident provenance records that are stored in the Humark registry.
Humark is not an AI detection service. The platform does not scan, analyze, or classify content to determine whether it was generated by artificial intelligence. Instead, Humark provides a positive attestation framework: creators voluntarily register their work and bind it to their verified biological identity through biometric signing.
The Service includes, but is not limited to: biometric key generation and management, asset registration and cryptographic signing, C2PA-compatible provenance manifests, a public verification registry, and API access for platforms and integrators.
Account Registration
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
You must be at least 18 years of age to create an account. By registering, you represent and warrant that you meet this eligibility requirement.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Humark immediately of any unauthorized use of your account or any other breach of security.
Humark reserves the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.
Creator Attestation & Registration Integrity
By activating the Humark biometric registration pipeline and submitting an asset for registration, you make the following attestation under penalty of account termination and civil liability:
- (a) you are the human creator of the submitted work
- (b) the work was not generated in whole or in substantial part by an artificial intelligence image generation system
- (c) you have the legal right to register this work under your biological identity
- (d) the information provided in connection with this registration is accurate and not misleading
You understand that this attestation is permanently recorded in the Humark registry and constitutes a legally binding declaration. Fraudulent attestation may expose you to civil liability under applicable fraud, misrepresentation, and consumer protection statutes, and in commercial contexts, to federal criminal liability under 18 U.S.C. 1343 (wire fraud).
Prohibited Uses
Users are expressly prohibited from:
- (a) submitting AI-generated images, artworks, or creative works through the Humark registration pipeline while representing them as human-created
- (b) using the Humark platform to obtain a Human Verified designation for works not created by the registering human
- (c) registering works on behalf of another person without that person’s biometric participation
- (d) using the Humark badge, manifest, or registry record to make false representations in any commercial transaction, grant application, licensing agreement, or public claim
- (e) circumventing, attempting to circumvent, or assisting others in circumventing the biometric verification requirements of the Humark platform
Violation of any of these prohibitions may result in immediate account termination, permanent revocation of all associated registry entries, and referral to appropriate legal authorities.
Provenance Challenge System
Humark maintains a formal challenge process to protect the integrity of the registry and the rights of all creators.
- Any user or third party may file a Provenance Challenge against a registered asset by submitting documented evidence to disputes@humark.id.
- Upon receipt, Humark will flag the asset as humark.status: disputed within 48 hours.
- The registrant will be notified and has 14 days to submit counter-evidence supporting the authenticity of their registration.
- Unresolved challenges may result in revocation of the registration, account termination, and referral to appropriate legal authorities.
- Humark does not warrant that all fraudulent registrations will be detected or challenged.
- Challenge records are maintained permanently and are accessible to law enforcement upon lawful request.
Registry Immutability
You acknowledge that Humark’s registry is designed to be append-only and tamper-evident. Registration records, including the cryptographic hash, biometric signature, timestamp, and creator assertions, are permanently recorded and cannot be deleted by the user after submission.
Account deletion will remove your profile and prevent future registrations but will not remove existing registry entries. This design is fundamental to the integrity and trustworthiness of the provenance system.
Indemnification
You agree to indemnify, defend, and hold harmless Humark, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:
- Fraudulent attestations you make through the Humark registration pipeline
- Third-party claims regarding the ownership, originality, or provenance of assets you have registered
- Commercial use of Humark manifests or badges in connection with false or misleading attestations
- Your violation of the Creator Attestation requirements or any other provision of these Terms
Limitation of Liability
Humark does not represent, warrant, or guarantee that the platform will detect all instances of AI-generated content registered as human-made, identify all fraudulent attestations, or prevent bad actors from misusing the registration system. The platform is an attribution and provenance infrastructure service, not an AI detection service.
To the maximum extent permitted by applicable law, Humark’s total aggregate liability to you for any claims arising out of or related to the Service shall not exceed the total fees you paid to Humark in the twelve (12) months immediately preceding the event giving rise to the claim.
In no event shall Humark be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action or the theory of liability, even if Humark has been advised of the possibility of such damages.
